By visiting our site and/or submitting an inquiry, requesting a quote, requesting samples, or placing an order through our site or via email communication referenced from our site, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").

2. COMPANY & SERVICES

Zhongda Sports specializes in the design, manufacturing, and distribution of commercial fitness equipment. Our core product categories include:

3. PRODUCT INFORMATION

4. OEM & ODM SERVICES

Zhongda Sports offers comprehensive OEM and ODM services. The following terms apply to custom manufacturing projects:

4.1 OEM Services

- Client provides product specifications, designs, and branding requirements

- Zhongda Sports produces products according to client's specifications

- Client branding, logo, and packaging customization available

- MOQ for OEM orders varies by product category (typically 100-500 units)

- Production lead time: 30-45 days after sample confirmation

4.2 ODM Services

- Client provides product concept or functional requirements

- Zhongda Sports R&D team handles design, prototyping, and testing

- Mold/tooling development fees apply for new product designs

- Mold fees may be refundable after reaching agreed order volume

- Development lead time: 45-90 days depending on complexity

4.3 Confidentiality

Both parties agree to keep all proprietary information, designs, specifications, and business terms confidential during the cooperation period and for 3 years thereafter, unless required by law or with prior written consent.

5. PRICING & PAYMENT TERMS

All prices listed on the website are for reference only and may not reflect current pricing. Final pricing is confirmed through formal quotation from our sales team.

5.1 Price Validity

Quotations are typically valid for 30 days from the date of issue. Prices may be adjusted due to fluctuations in raw material costs, exchange rates, labor costs, or other market factors.

5.2 Payment Terms

Standard payment terms:

- T/T (Telegraphic Transfer): 30% deposit upon order confirmation, 70% balance before shipment

- L/C (Letter of Credit): Irrevocable L/C at sight (subject to bank charges)

- Other payment terms may be negotiated for long-term partners

5.3 Currency

All international transactions are conducted in US Dollars (USD) unless otherwise agreed in writing. RMB pricing is available for domestic Chinese orders.

6. SAMPLE POLICY

We offer sample services to help clients evaluate product quality before placing bulk orders:

- Sample Availability: Available for most standard products

- Sample Cost: Samples are charged at sample price (typically 1.5-2x of unit price). Sample fee may be refunded upon confirmation of bulk order.

- Sample Lead Time: 5-10 working days for standard samples; 15-30 days for custom/OEM samples

- Shipping: Sample shipping cost is borne by the client. We can ship via DHL, FedEx, UPS, or client's designated courier.

- Custom Samples: Custom branding or modifications require additional time and cost

7. QUALITY ASSURANCE & INSPECTION

Zhongda Sports is committed to delivering high-quality fitness equipment. Our quality management system includes:

- ISO 9001 certified quality management system

- TUV, SGS, and UL certified products (where applicable)

- Three-layer quality inspection: incoming material inspection, in-process inspection, and final inspection

- Raw material testing (hardness, density, tensile strength, etc.)

- Finished product testing (load capacity, durability, safety standards)

7.1 Third-Party Inspection

Clients may arrange for third-party inspection (such as SGS, TUV, BV) before shipment. Inspection fees are borne by the client unless otherwise agreed.

7.2 Quality Issues

If quality issues are identified upon receipt of goods, client must notify Zhongda Sports within 7 days of receipt, accompanied by photographic evidence. We will investigate and provide a resolution, which may include replacement, repair, or credit, at our discretion.

8. DELIVERY & SHIPPING

8.1 Production Lead Time

- Standard products (in stock): 7-15 working days

- OEM orders: 30-45 working days after deposit and sample confirmation

- ODM/new product: 45-90 working days depending on complexity

8.2 Shipping Terms

We support various Incoterms 2020 shipping terms:

- EXW (Ex Works) - Client arranges all shipping from our factory

- FOB (Free On Board) - We deliver to designated Chinese port

- CIF (Cost, Insurance, Freight) - We arrange shipping and insurance to destination port

- Other terms (CFR, DDP, DAP) negotiable

8.3 Shipping Methods

- Sea freight (FCL/LCL): For large volume orders

- Air freight: For urgent or small volume orders

- Express: For samples and very small orders (DHL, FedEx, UPS)

Delivery times are estimates only and may be affected by factors beyond our control, including but not limited to port congestion, customs clearance, weather conditions, and shipping carrier delays.

9. MINIMUM ORDER QUANTITY (MOQ)

Zhongda Sports sets minimum order quantities to ensure cost-effective production:

- Standard products: MOQ varies by product, typically 10-100 units

- OEM (with custom logo/labeling): Typically 100-500 units

- ODM (new product development): Typically 500-1000 units

- Trial orders: Smaller quantities may be accepted for first-time clients at adjusted pricing

Specific MOQ for each product is confirmed at the time of quotation. We reserve the right to decline orders below MOQ or charge a premium for small-batch production.

10. WARRANTY

Zhongda Sports warrants that all products will be free from defects in materials and workmanship under normal use. Warranty periods vary by product category:

- Frame/Structure: 2-5 years warranty (varies by product)

- Wearable parts (pads, cables, belts, bearings): 90 days to 1 year warranty

- Electronic components (motors, controllers, displays): 1-2 years warranty

- Accessories: 90 days warranty

Warranty does not cover:

- Damage from improper installation, misuse, or neglect

- Damage from accidents, natural disasters, or unauthorized modifications

- Normal wear and tear

- Damage from use beyond product's rated capacity

Warranty claims must be submitted within the warranty period from date of delivery, with supporting documentation and photographs. Our warranty obligation is limited to repair or replacement of defective parts, at our discretion.

11. INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, images, product designs, logos, trademarks, and graphics, is the property of Zhongda Sports and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the website content without express written permission from Zhongda Sports.

For OEM/ODM projects, intellectual property rights shall be defined in a separate agreement. Client-provided designs, logos, and branding materials remain the property of the client. Zhongda Sports' proprietary designs, manufacturing processes, and technology remain the property of Zhongda Sports.

12. PRIVACY & DATA PROTECTION

Your submission of personal information through this website (including inquiry forms, quote requests, and email communications) is governed by our Privacy Policy. Zhongda Sports is committed to protecting your personal information and will not sell, rent, or share your contact information with third parties without your consent, except as required by law or as necessary to fulfill your order.

Our total aggregate liability for any claim arising out of or relating to these Terms or the products or services shall not exceed the total amount paid by you to Zhongda Sports for the specific order giving rise to the claim.

15. DISPUTE RESOLUTION

Any disputes arising from or related to these Terms of Service, our products, or services shall be resolved through the following process:

1. Negotiation: Both parties shall first attempt to resolve the dispute amicably through direct negotiation within 30 days of written notice.

2. Mediation: If negotiation fails, either party may propose mediation with a neutral third party.

3. Arbitration: If mediation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration. The arbitration shall be conducted in Guangzhou, China, in the English language. The arbitral award is final and binding upon both parties.

These Terms of Service shall be governed by and construed in accordance with the laws of the People's Republic of China.

16. MODIFICATIONS TO TERMS

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.
